Acceptance of Terms

By making a reservation, dining at our restaurant, or using our website, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

These terms constitute a legally binding agreement between you and Lumios B.V., a company registered in the Netherlands with registration number 94175208.

Restaurant Services

Lumios provides dining services at our restaurant located at Hoofdstraat 126, 4815 QI Breda, Netherlands. Our services include:

• Table dining and food service
• Beverage service including alcoholic beverages
• Reservation management
• Private dining and event services
• Customer support and assistance

We reserve the right to modify our services, menu offerings, and operating hours at our discretion with reasonable notice.

Reservations and Booking

Reservations can be made by phone or through our website. All reservations are subject to availability and confirmation by Lumios staff.

Reservation Policy:

• Reservations must be made at least 2 hours in advance
• Tables are held for 15 minutes past the reservation time
• Cancellations must be made at least 2 hours before the reservation time
• No-shows may be subject to charges for large parties
• We accommodate dietary requirements when notified in advance
• Large parties (8+ people) may require a deposit

User Conduct and Responsibilities

When using our services or visiting our restaurant, you agree to:

• Behave respectfully towards staff and other guests
• Comply with our dress code and restaurant policies
• Provide accurate information for reservations
• Pay for all services rendered in a timely manner
• Report any concerns or issues promptly to our staff
• Follow health and safety guidelines

We reserve the right to refuse service or ask guests to leave if these standards are not met.

Payment and Pricing

All prices are listed in Euros (EUR) and include applicable taxes. Payment is due at the time of service unless other arrangements have been made.

• Major credit and debit cards
• Contactless payments and mobile payment systems

Menu prices may change without notice. Service charges may apply to large parties as indicated on your bill.

Intellectual Property

All content on our website, including but not limited to text, graphics, logos, images, recipes, and software, is the property of Lumios or its licensors and is protected by copyright and other intellectual property laws.

You may not use, reproduce, distribute, or create derivative works from our content without our express written permission. The Lumios name, logo, and branding are trademarks of Lumios B.V.

Privacy and Personal Data

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which forms part of these Terms of Service.

By using our services, you consent to the collection and use of your information as described in our Privacy Policy.

Limitation of Liability

To the maximum extent permitted by law, Lumios shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.

Our total liability for any claims arising from or related to our services shall not exceed the amount paid by you for the specific service giving rise to the claim.

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

Force Majeure

Lumios shall not be liable for any failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to:

• Natural disasters, extreme weather conditions
• Government regulations or public health orders
• Labour strikes or disputes
• Equipment failure or utility outages
• Supply chain disruptions

Termination

We reserve the right to terminate or suspend your access to our services immediately, without prior notice, if you breach these Terms of Service or engage in conduct that we deem inappropriate or harmful.

You may discontinue using our services at any time. Upon termination, your right to use our services ceases immediately.

Termination does not affect any rights or obligations that accrued before the termination date.

Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the Netherlands. Any disputes arising from these terms or your use of our services shall be subject to the exclusive jurisdiction of the Dutch courts.

If you are a consumer resident in the European Union, you may also have rights under local consumer protection laws in your country of residence.

Severability

If any provision of these Terms of Service is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining terms remain in full force and effect.
